In accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, every User has the right to information, to object, to access and to rectify information held about them. Any User wishing to exercise these rights and obtain a copy of their data may contact Local Hours via the contact form.
In accordance with applicable telecommunications regulations, any User may also request, free of charge, from their telephone service provider(s) not to be listed, or to be listed with certain restrictions, on subscriber lists provided to the Local Hours directory enquiry service. Local Hours will take into account requests made directly to the User's telephone service provider(s) within 24 hours of Local Hours receiving the relevant information from the provider.
When a member registers, the User's personal data is collected, processed and used in compliance with UK data protection legislation.
The protection of personal data of its Users and of the individuals whose data is the subject of the Service is a priority for Local Hours. Local Hours has therefore appointed a Data Protection Officer (DPO) to ensure optimal protection of personal data, in close collaboration with the Information Commissioner's Office (ICO).

Advertising and unlawful solicitation

The use for commercial purposes or public distribution of data downloaded from the Site is strictly prohibited and may be subject to criminal penalties for unlawful collection of personal data. Local Hours reserves the right to report any such breach to the ICO.

These Terms of Use are the property of Local Hours. Any distribution, exploitation, reproduction or use, in whole or in part, on any medium, of these Terms for purposes other than strictly personal use, requires the prior authorisation of Local Hours. Failure to obtain such authorisation may result in civil and criminal proceedings.
Local Hours is an innovative geo-location platform that allows users, subject to prior registration, to create, comment on and share descriptions and reviews of businesses. Local Hours does not guarantee the accuracy of information presented, which is submitted under the sole responsibility of members. Local Hours is therefore not responsible for content that users post online (images, photos, etc.). In accordance with internet practice, advertising may appear on the Site. Trade marks appearing on this site remain the property of their owners. Local Hours does not acquire any proprietary rights over your content.

Users should be aware of their responsibility for their content, which will be seen by thousands of visitors to the Local Hours site. You are informed that, given the inherent nature of the internet, transmitted data, including your Content, is not protected against the risks of interception and/or hacking, for which we cannot be held responsible. It is your responsibility to take all appropriate measures to protect such data. You therefore acknowledge that files may be subject to unauthorised third-party intrusion and may be corrupted or downloaded, that information circulating on the internet is not protected against possible diversion or viruses, and that any person may create a link giving access to your file. Local Hours shall in no event be liable for damage of any kind, whether accidental or otherwise, suffered by you or third parties, whether or not caused by third parties.

Furthermore, during the period of hosting your Content and strictly within the scope of functionalities enabling the Site to be made accessible via the internet or other electronic communications media, you authorise us to reproduce/display your Content and, as necessary, to adapt its format in order to comply with the Site's graphic guidelines and to ensure compatibility with its technical performance or the formats of the relevant media. These rights are granted by you to Local Hours Ltd for the whole world and for the entire duration of the hosting of your Content.

You are also prohibited from copying, reproducing and/or using content belonging to other users except for the strict purposes of using the Site's Services for personal and private use. If you wish to make any other use, in particular commercial use, of another user's Content, you must first obtain the necessary authorisations from that user.

2. Access and registration for Local Hours Services
To access the Site and use its services, you must have the computer equipment, software, telecommunications means and settings necessary for the proper operation of the internet. Such equipment is exclusively your own responsibility, as are the telecommunications costs incurred by their use. You warrant that you are aware of the characteristics of internet usage.

In order to use the Site's features, you must create an account using the online registration form. You remain free at any time to modify the Personal Data provided on that occasion. Once the form is submitted, you will receive an email inviting you to click on a link to confirm your registration. Access to your account can be made by entering your username and associated password, which you alone are responsible for keeping confidential. Use of the Site following your registration is valid for an indefinite period.

If you are a minor, you must first obtain authorisation from your parents or legal guardian(s) before registering and/or using the Services.
Where Services are accessed by minors, parents (or legal guardians) are strongly advised to monitor their children's use of the Services and to keep in mind that the Services are intended for a wide audience; it is their responsibility to determine which services are appropriate for their child(ren) and to monitor their use. Local Hours reminds you that browsers and certain specific software allow filtering of access to sensitive or unsecured content. You are solely responsible for acquiring, using and configuring such filtering systems.

The member warrants that the information they provide is accurate and truthful. They undertake to inform Local Hours promptly of any change to information provided at registration and, where appropriate, to make such changes themselves in their personal area on the Local Hours site.

Once the conditions for registration are met, each member has one or more username(s) (login) and one or more password(s), depending on the different Services to which they have registered (internet, newsletters, etc.), which are strictly personal and confidential and must not be communicated or shared with third parties.

Except in the event of fault on the part of Local Hours or a technical failure of the Service, the member will be responsible for the use of these identification elements by third parties or for actions or statements made via their personal member account, whether fraudulent or not, and indemnifies Local Hours against any claim in this regard. Furthermore, Local Hours is not obliged to and does not have the technical means to verify the identity of persons registering for its Services. If a member has reason to believe that another person is using their identification details or account, they must notify Local Hours immediately.

As a security and quality measure, Local Hours deactivates the accounts of members who have not been used for a period of 12 months or more after the termination of a subscription.

It is important to take certain precautions when meeting other members. Local Hours accepts no liability for meetings between Local Hours members, on or off the platform, or for meetings between members and/or non-members following use of the Local Hours site and Services. For any first in-person meeting, it is advisable to inform a trusted person.

In this context, Local Hours reminds its members that they are prohibited from disclosing to other members information enabling their identification (other than their member username), such as surname, postal and/or email address, or phone number, to other Local Hours members through the Services.


Users may normally access the Site 24 hours a day, 7 days a week, throughout the year, although this is not a binding obligation on Local Hours. Local Hours reserves the right, without notice, to temporarily suspend access to all or part of the services that are the subject of these terms, for reasons beyond its control or for technical reasons relating in particular to the need to update, modify or maintain the services, and, generally, for any other technical or organisational reason. Accordingly, Local Hours shall not be liable for any temporary or total unavailability of all or part of access to the services, any difficulty related to response times, any performance failure, or the presence of viruses on the Site.

 

3. Prohibited content

Local Hours is legally required to put in place an easily accessible and visible mechanism allowing anyone to bring to its attention the distribution, via the Site, of content relating to:

glorification of crimes against humanity, incitement to racial hatred, child pornography, incitement to violence, attacks on human dignity.

You have access to a dedicated form by clicking the "Report" link, systematically located next to the content. You may also send us a detailed letter specifying the date, your identity, the URL of the offending content, its description and the identifier of its author.

Upon receipt by Local Hours of a report addressing the above offences, the relevant content will be immediately removed from the Site and the relevant public authorities will be notified.

For information purposes, it is noted that any person who represents content or an activity as unlawful in order to obtain its removal or to cause it to cease, when they know that information to be false, may be subject to criminal prosecution.

External links / hyperlinks:
Local Hours is only responsible for the hyperlinks it creates and exercises no control over external sites and sources to which hyperlinks accessible on the Service (not created by Local Hours) redirect. It shall not be held responsible for making available links directing to external sites and bears no responsibility for their content, advertising, products, Services or any other element available on or from those external sites of which it has no prior effective knowledge.

Any difficulty relating to a link must be submitted to the administrator or webmaster of the site in question. It is also noted that consultation and/or use of these external sites and sources is governed by their own Terms of Use.

Finally, if, as a result of a search conducted on the Local Hours site, a member is directed to sites, pages or forums whose title and/or content constitutes a violation of applicable law, the member is invited to stop browsing the relevant site, as failure to do so may engage their own liability, to the exclusion of that of Local Hours.


As a provider of Content to the Site, whether videos, photos, texts and/or comments, you are required to comply with applicable legal and regulatory provisions. You must accordingly ensure that the storage and distribution of such Content via the Site does not constitute, in particular, (i) an infringement of third parties' intellectual property rights (including clips, television programmes, films, animations or advertising material which you have not produced yourself or for which you do not hold the necessary authorisations from the relevant rights holders), (ii) an attack on individuals (including defamation, insults, abuse, denigration, etc.) or an infringement of the right to privacy, (iii) an attack on public order or morality (including glorification of crimes against humanity, incitement to racial hatred, child pornography, etc.), (iv) an act of unfair competition.

Data collected

The Data collected and subsequently processed by us is that which you voluntarily provide via the Site's registration form and relates, at a minimum, to your town, postcode, a username, a password and a valid email address. Data automatically collected by the Site includes your IP address only. In addition, in the course of using the Site, you may be asked to provide certain information, indications and/or content (photographs and/or videos) on an optional basis. USE OF COLLECTED DATA
By registering on the Site and accepting these Terms, you expressly agree to Local Hours Ltd's use of the information provided. Personal information and Data concerning you, collected at registration and during use of the Site, are used by Local Hours Ltd and its websites to provide you with our services. All reasonable precautions have been taken in our databases to archive your information in a secure environment. This information is only accessible by certain members of our staff when necessary. Personal information provided at registration, other than your username and town, will not be made accessible to third parties, nor transmitted or exchanged. Subject to your prior consent, Local Hours Ltd may send you promotional offers from certain of its partners. If you prefer not to receive such promotional offers, selected by Local Hours Ltd for you, you may indicate this at registration, or at any time, in your personal area on the Local Hours site or by contacting us at contact@local-hours.uk.

 

Recipients of Data

You have the right to access and rectify your Data by sending us a request via your listing's "report an error" function, the contact form, or by post.

In accordance with applicable regulations, data collected at registration is retained by Local Hours as evidence of the contract, as well as evidence of communications and any data exchanges. Such data is archived by Local Hours on a reliable and durable medium in accordance with applicable legal provisions. In the event of any discrepancy between data held by Local Hours and any document provided by you, it is expressly agreed that Local Hours' records shall take precedence over your documents and shall alone be admissible as evidence. When you use the Site's services, our servers automatically record information such as your IP address, browser type and language, and the date and time of each connection.
